General Terms of Service

(Allgemeine Geschäftsbedingungen)

1. Scope and Provider

1.1 These General Terms of Service ("Terms") apply to contracts concluded via raw-facilitation.guide between you as our customer and:

RAW Facilitation GbR, with partners Felix Bruns, Cora Niemeier, and Jonas Baumgart, Friemer Straße 17, 37284 Waldkappel, Germany. Email: contact@raw-facilitation.guide.

In these Terms, RAW Facilitation GbR is referred to as "we", "us", or the "Provider".

1.2 These Terms apply to the supply of our digital book in PDF format ("Handbook"). Any future product is subject to these Terms only if we expressly state this at the time of purchase.

1.3 A consumer within the meaning of these Terms is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. An entrepreneur is any natural or legal person or partnership with legal capacity acting in the exercise of their trade, business, or profession. The statutory definitions in §§ 13 and 14 BGB apply.

2. Subject Matter of the Contract

2.1 We offer the Handbook as a digital product in PDF format on a pay-what-you-want basis. You choose the amount you wish to pay, including 0 €.

2.2 The Handbook is supplied as a digital PDF file only. No physical copy is delivered and no data carrier is shipped.

2.3 The specific content and scope of the Handbook result from the product description on our website at the time of the order.

3. Conclusion of Contract

3.1 The presentation of the Handbook on our website does not constitute a legally binding offer, but an invitation to place an order.

3.2 To place an order, you submit a binding offer to conclude a contract for the supply of the Handbook by completing the final checkout step in Stripe Checkout after choosing the amount, including €0. If you choose an amount greater than €0, this checkout step creates a payment obligation.

3.3 For a paid order, we accept your offer only after Stripe has confirmed successful payment. For a €0 order, we accept your offer after Stripe has confirmed successful completion of the Stripe Checkout process. In both cases, we accept your offer by sending our confirmation email with the download link.

A pending, failed, or abandoned Stripe Checkout session or payment is not accepted and does not trigger delivery. If a paid order is successfully paid but we cannot fulfil it, we will notify you and refund the payment without undue delay.

3.4 The contract is concluded in English. We do not provide a customer account through which the contract text can be accessed after conclusion of the contract. Our confirmation email contains the order details and a link to the Terms and withdrawal information applicable to the order. We preserve the version applicable to the order in our records. You should save the confirmation email and any payment receipt you receive.

4. Prices and Payment

4.1 You choose the amount shown in the order process, including €0. The amount chosen is displayed before you submit the binding order.

4.2 No VAT is charged separately where the applicable tax rules permit this. We apply the German small business regulation under Section 19 of the German VAT Act.

4.3 Stripe is used as our checkout service provider for all orders and as our payment service provider for orders where an amount greater than €0 is chosen. RAW Facilitation GbR remains the contractual seller of the Handbook. Stripe is not the seller or merchant of record. The payment methods available for paid orders are shown during the Stripe Checkout process. Stripe will send a separate payment receipt for paid orders.

4.4 If you choose €0, Stripe Checkout is still used, but no payment transaction or charge is triggered. A contract for the supply of the Handbook is nevertheless concluded when we accept the order under Section 3.3. These Terms, including the voluntary withdrawal policy in Section 6, apply to the €0 order.

5. Delivery of the Digital Content

5.1 After we accept your order, we send you a confirmation email containing a download link for the Handbook. For a paid order, we send this email only after Stripe has confirmed successful payment. For a €0 order, we send it after Stripe has confirmed successful completion of the Stripe Checkout process and we have accepted the order.

5.2 You are responsible for providing a valid email address and for ensuring that our email can be received, for example by checking your spam filter. If you do not receive the confirmation email or the download link does not work, please contact us at contact@raw-facilitation.guide.

5.3 You need an internet connection, a valid email address, and software capable of opening PDF files.

6. Right of Withdrawal for Consumers

6.1 Consumers have a 14-day right of withdrawal from this contract without giving a reason, subject to the details and legal conditions in Section 11.

6.2 We voluntarily offer the same 14-day withdrawal period for paid and €0 orders. This voluntary policy does not mean that the statutory classification and statutory withdrawal rules are identical for paid and €0 orders. Mandatory consumer rights remain unaffected.

6.3 We provide the Handbook immediately after the contract is concluded by sending the confirmation email with the download link. We do not ask you to consent to the expiry of the withdrawal right before delivery.

6.4 Mandatory statutory consumer rights remain unaffected.

6.5 You may exercise the withdrawal right by sending an unequivocal declaration by email to contact@raw-facilitation.guide or by post to RAW Facilitation GbR, Friemer Straße 17, 37284 Waldkappel, Germany. We do not currently provide a separate online withdrawal function.

7. Licence and Rights of Use

7.1 The Handbook is licensed under the Creative Commons Attribution 4.0 International Licence (CC BY 4.0). The licence text is available at https://creativecommons.org/licenses/by/4.0/.

7.2 Under the CC BY 4.0 licence, you may share and adapt the Handbook, including for commercial purposes, provided that you give appropriate credit, provide a link to the licence, and indicate whether changes were made.

7.3 Please credit the work as follows:

7.4 We chose this licence to allow the work to be shared freely and to avoid compatibility issues with other types of licences. We ask, but do not require, you to publish adaptations under the same licence or another licence that allows the same freedoms.

7.5 The name “RAW Facilitation” and related marks are not covered by the CC BY 4.0 licence. You may truthfully identify the original work and its authors and may refer to the original work. You may not use the name “RAW Facilitation” in a way that falsely suggests that we created, endorsed, sponsored, or are affiliated with your adaptation or shared copy.

8. Conformity and Warranty

8.1 We provide the Handbook in the agreed quality and free from defects. The statutory provisions applicable to contracts for digital products apply where their legal requirements are met. The statutory classification and remedies for a €0 order may differ from those for a paid order; this does not limit the voluntary promises made in these Terms or any mandatory rights.

8.2 If the Handbook is defective, you may request that we restore conformity. If we fail to do so, you may terminate the contract or reduce the price paid, in accordance with the statutory provisions.

8.3 Please report defects, including corrupted files or non-functioning download links, to contact@raw-facilitation.guide. We will address the issue without undue delay and provide a working file or other remedy.

8.4 The Handbook is sold as the version available at the time of your order. We do not promise editorial updates or updated editions. If we publish a new edition, it is a separate version and may be purchased or downloaded separately. This does not limit any mandatory statutory obligations.

9. Liability

9.1 We are liable without limitation under the applicable statutory provisions for damages resulting from intent or gross negligence, injury to life, body, or health, a breach of an expressly given guarantee, fraudulent concealment of a defect, liability under the German Product Liability Act, and any other liability that cannot be limited under mandatory law.

9.2 In cases of slight negligence, we are liable only for the breach of an obligation that is essential to the performance of this contract and on whose fulfilment you may ordinarily rely. In such cases, our liability is limited to the foreseeable, contract-typical damage.

9.3 The limitations in this Section also apply in favour of our legal representatives, employees, and other agents. They do not limit your statutory rights relating to defects in digital products or any other mandatory statutory rights.

9.4 The Handbook offers general educational content. It is not medical, psychological, therapeutic, or legal advice, and it does not replace a professional’s diagnosis, treatment, or consultation. This notice does not exclude or limit any statutory rights or liability that cannot legally be excluded or limited.

10. Consumer Dispute Resolution

We are not legally required to take part in dispute resolution proceedings before a consumer arbitration board. That said, if you ever have a concern, please reach out to us directly, we're happy to work things out together.

11. Withdrawal Instructions for Consumers

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day of the conclusion of the contract.

To exercise your right of withdrawal, you must inform us of your unequivocal decision by email to contact@raw-facilitation.guide or by post to RAW Facilitation GbR, Friemer Straße 17, 37284 Waldkappel, Germany. You may use the model withdrawal form below, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from a paid order, we shall reimburse all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw. We will use the same means of payment as you used for the initial transaction unless you expressly agree otherwise. You will not incur any fees as a result of the reimbursement.

12. Final Provisions

12.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence.

12.2 If you are a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is our registered office, to the extent legally permissible.

12.3 Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected.
